Terms of Service

By accessing or using PokePet Shop, you agree to these Terms. If you do not agree, please do not use the site.

1. Products & Services

PokePet Shop offers personalized retro-style games delivered as digital playable URLs, optionally bundled with physical prints (poster, canvas, framed print, trading card). Each product is custom-made to your specifications — character names, kid details, dedications, photos, and other personalization fields.

2. Customization Content

You retain ownership of the personal content you submit (names, photos, dedications). You grant us a non-exclusive, worldwide license to use that content solely to fulfill your order — render the game, print the physical product, and deliver these to you.

You confirm that any photos you upload are yours to share, do not infringe third-party rights, and do not depict illegal or harmful content. We reserve the right to refuse orders containing content we deem inappropriate (full refund issued in such cases).

3. Pricing & Payment

Prices are displayed in your local currency where applicable, or in USD where local-currency display is unavailable. Final amounts at checkout are the binding price. Payment is processed by Shopify Payments; we do not handle card details directly.

4. Delivery

Digital game URLs are emailed within 24 hours of payment in normal course (most orders deliver same-day via the daily fulfillment batch at 6 AM EST). Physical prints ship from our US fulfillment partner; international shipping times vary by region (typical 7–21 business days). Delays caused by carrier, customs, or natural disaster are outside our control.

6. Account & Edits

Each order receives an edit link valid for 14 days post-fulfillment that lets you correct names, dedications, or photos. After 14 days, edits are at our discretion and may incur a re-print fee for physical products.

7. Intellectual Property

The game engine, customizer, art assets, and brand are owned by us. You may not copy, reverse-engineer, or redistribute the game or its assets. Your customized output is for personal use only — commercial reproduction is not permitted without written permission.

8. Liability

Our total liability for any claim arising from your purchase is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages. Some jurisdictions do not allow this limitation; in those, our liability is limited to the maximum extent permitted by local law.

10. Changes to These Terms

We may update these Terms periodically. Continued use of the site after a revision constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which the brand operates. EU consumer law rights remain unaffected for EU customers.
